Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ or order, orders or directions more particularly one in the nature of Writ of Mandamus - i) declaring the action of the 6th respondent in transferring the petitioner from 8th respondent School to 9th respondent Office vide Rc.No.1447/2025.E5, dt.09-06-2025 by forging her signatures only to accommodate 10th respondent in her working place as illegal, arbitrary, discrimination, unjust, contrary to law, opposed to doctrine of legitimate expectation, letter and spirit of the general transfer guidelines issued under G.O.Ms.No.23, Finance (HR.I-PIg.
and Policy) Department, dt.15-05- 2025 besides violative of Arts.14, 16 and 21 of the Constitution of India, and ii) consequentially, set-aside the same besides directing the

6th and 8th respondents to allow the petitioner to continue in respondent School by according all incidental and consequential service-cum-monitory benefits by treating the period from which date the petitioner got relieved till she is going to report for duties as on duty for all practical purposes including for payment of back-wages and pass such other order. Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to suspend the operation of 6th respondent’s transfer orders issued vide Rc.No.1447/2025.E5, dt.09-06-2025 in order to allow the petitioner to work in 8th respondent School and pass such other order. ORDER:
1. In the present Writ Petition, the Petitioner is questioning the action of Respondent No.6 in transferring the Petitioner from Respondent No.8-school to Respondent No.9-office vide Rc.No.1447/2025.E5, dated 09.06.2025 by forging the signatures of Petitioner only to accommodate Respondent No.10, in her working place, as illegal and arbitrary.
2. This Court had called for the application of transfer along with Attendance Certificate and options of places in the counseling of general transfers allegedly exercised by the Petitioner.
3. After perusing the said documents submitted before this Court on 10.09.2025, this Court directed the Petitioner to file an affidavit to face consequences, in the event the allegation of forgery of transfer application is found to be false. The Petitioner accordingly filed additional affidavit vide USR.No.10256/2005, dated 11.09.2025.
4. After filing the additional affidavit, the counsel for the Petitioner submitted that though the Petitioner stands by the additional affidavit on 11.09.2025, but expressed concern that the Petitioner being an

Office Subordinate and a widow would become a target of the superiors and in that context, it would suffice, if the Petitioner is posted at vacancies in nearby Zilla Parishad school. An additional affidavit was again filed vide WP.USR.No.111287/2025 on 26.09.2025 for this relief.
5. Learned Standing Counsel appearing for the Respondent-school submits that the case of the Petitioner for posting to nearby schools would be considered by the Respondent authorities taking into
consideration the family scenario and the nature of job as Office Subordinate.
6. Taking note of submissions and in particular the additional affidavit filed vide USR No.111287 of 2025, dated 26.09.2025, the Writ Petition is disposed of with the consent of the Petitioner as well as the learned Standing Counsel, at the admission stage, with the following directions;
i) The Petitioner shall give a representation to the Respondents
within a period of two (2) weeks from today for reconsideration
of her transfer as Office Subordinate in nearby vacancies
closer to the erstwhile place of posting of the Petitioner i.e.
Panchali;

ii) On receipt of the representation, the Respondents shall
consider the same taking note of the family scenario of the
Petitioner and pass appropriate orders, within a period of two
(2) weeks thereof.
(iii) No order as to costs.
7. As a sequel, pending applications, if any, shall stand closed.
