JUSTICE AJIT KUMAR ORAL ORDER 5 19-03-2026 Heard the learned counsel for the petitioner and learned APP for the State. 2. The petitioner makes a prayer for bail in connection with Sonpur @ Sonepur P.S. Case No.1094 of 2024, F.I.R dated 28.12.2024 registered for the offences punishable under Sections 319(2), 318(4), 316(2), 316(5), 338, 336(3), 340(2) and 61(2) of the Bharatiya Nyaya Sanhita, 2023. 3. As per the prosecution case, the informant, Bahadur Paswan, alleged that CSP operators Sumit Kumar and Ravish Kumar fraudulently obtained his thumb impressions and embezzled about Rs.4,70,000 from his SBI account. It is further alleged that they similarly cheated hundreds of villagers by citing server issues, resulting in misappropriation of crores of rupees, and thereafter absconded. Learned counsel for the petitioner submits that co- accused, namely, Sumit Kumar, who is CSP operator at the State Bank of India and petitioner was his assistant only and save and except this petitioner being his assistant, there is nothing incriminating which is said to have surfaced during the course of investigation. It is further submitted that the investigation in the instant case has already been completed and charge-sheet has also been filed and the main accused, namely, Sumit Kumar, is said to have been released on regular bail by a Co-ordinate Bench of this Court vide order 30.04.2025 passed in Cr. Misc. 24438 of 2025. Lastly, it has been submitted that the petitioner is languishing in judicial custody since 08.08.2025. 5. Learned Additional Public Prosecutor for the State opposes the prayer for regular bail and does not dispute the fact that the co-accused, namely, Sumit Kumar, has already been allowed the privilege of regular bail. 6. Considering the facts and circumstances that CSP operator, under whom the petitioner was working as an Assistant is the main accused in this case and nothing incriminating has surfaced against this petitioner in the instant case and the petitioner is languishing in Patna High Court CR. MISC. No.79298 of 2025(5) dt.19-03-2026 3/3 judicial custody since 08.08.2025, the petitioner is enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned CJM, Saran, in connection with Sonpur @ Sonepur P.S.
