The Court made the following: ORDER:
This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“.... to issue a writ, order or direction more particularly one in the nature of mandamus declaring the inaction of the Respondents No. 2 to 4 in considering the representation dated 02.12.2019 submitted by the Petitioner in the SPANDANA PROGRAMME for necessary action against the Respondent Nos. 5 to 8 who are harassing the Petitioner illegally by cheating the Petitioner as illegal, arbitrary, unjust and contrary to the settled principles of law and consequently direct the Respondents No. 2 to 4 to take necessary action against the Respondents No. 5 to 8.”
2. Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that the disputes between the parties are purely civil in nature. 3.
For ready reference, the written instructions are extracted hereunder:
“I also submit that I have personally informed the Respondent/Petitioner that the issue is purely civil in nature and she also executed the GPA, the police have no jurisdiction to interfere into the issue and accordingly advised her to approach the Court of law for Justice.”
4. In that view, the Writ Petition is disposed of. However, the Petitioner is at liberty to work out her remedies before appropriate forum in accordance with law. There shall be no order as to costs.
