The case of the petitioner is that, on 08.03.2025, the vehicle of the 2. petitioner was engaged for transportation of rice by Bijjam Adi Lakshmi, on payment of hire charges. When the said vehicle reached near Kasturibai Girls Hostal, Guntupalli Village, the 3’’'^ respondent herein and other officials stopped the vehicle, checked and seized the vehicle on the allegation that the said rice is PDS rice. Then the 3^'^ respondent has made a complaint to the 4 respondent and registered Crime No. 12 of 2025 under Sections 318(4) of Bharatiya Nyaya Sanhita, 2023 (for short ‘the B.N.S.’) and Section 7 of Essential Commodities Act, 1955 (for short ‘the E.C.Act’) and handed over the vehicle to the 4‘^ respondent for safe custody. Then the 2"'^ respondent herein directed the petitioner to furnish bank guarantee for an amount of Rs. 1,12,500/- for release of the seized vehicle within 15 days. Hence, the Writ Petition. th \ 3. Heard learned counsel for the petitioner and Learned Assistant Government Pleader for Civil Supplies. Considering the submissions made by both the parties, without going into the merits of the case, the Writ Petition is disposed of, directing the petitioner to pay 50% of the amount before Joint Collector and for the remaining 50%, the petitioner shall furnish bank guarantee within a period of one week.
