[2025:RJ-JP:46614] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 13211/2025 Lali Devi W/o Janpal, R/o Makaan No. 578 Main Dcm Road Indra Gandhi Nagar Police Thana Udyog Nagar Kota City (Rajasthan) (At Presently Confined In Womens Prison Reformatory District Kota). ----Petitioner Versus The State Of Rajasthan, Through The Pp ----Respondent For Petitioner(s) : Ms. Harshita Sharma For Respondent(s) : Mr. Naresh Kumar Gupta, PP HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 19/11/2025 1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.327/2024 registered at Police Station Udhyog Nagar (Kota City), District-Kota City for offences under Sections 420, 406, 467, 468 and 120B of IPC. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that the petitioner is 62 years old lady and there is a delay of 2 to 3 years in lodging the FIR. He also submits that the allegation against the present petitioner is that, despite being aware of the complainant’s previous ownership, she obtained a lease deed of the property from UIT, Kota on the basis of forged documents. It is contended that the petitioner is a bona fide purchaser of the [2025:RJ-JP:46614] (2 of 2) [CRLMB-13211/2025] property and had no role whatsoever in obtaining the lease deed from UIT, Kota by fraudulent means. He further submits that an alternative remedy for challenging the validity or maintainability of the lease deed exists before the Civil Court. It is also argued that no specimen signature of the petitioner was taken for examination by the FSL and no document was sent to the FSL for comparison. Petitioner is behind the bars since 26.09.2025. No custodial interrogation is required. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, hence, the bail application of the petitioner may be allowed. 4. Learned Public Prosecutor has vehemently opposed the bail application. 5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, but without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 6. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioner-Lali Devi W/o Janpal shall be released on bail on her furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for her appearance before that Court on all the dates till conclusion of the trial.
