The petitioner has preferred the present petition inter alia with the following prayer:- "(i) Issue a Writ, order or direction in the nature of Mandamus commanding and directing to the respondents to cancel the proposal/process of allotment of fair price shop in favour of respondent no. 8 of Village Panchayat Ram Nagar, Block & Tahsil Pharenda, District Maharajganj." 2. Counsel for the petitioner placed reliance upon the report submitted by Block Development Officer, Block Pharenda, District Maharajganj dated 07.02.2025 appended as Annexure No. 11 to the petition, on the basis of aforesaid it is argued that the fair price shop license has been granted in favour of the respondent no. 8 on 18.02.2025. 3. Neither the copy of aforesaid order has been appended nor any prayer has been made to quash the aforesaid order. 4. At this point of time, a prayer has been made by the counsel for the petitioner to dismiss the present petition as not pressed with liberty to file a fresh petition. 5. Prayer is allowed. 6. Accordingly, the petition is dismissed as not pressed with liberty as prayed for. 7. Certified copy of order which is appended along-with the writ petition, office is directed to return the same to the learned counsel for the petitioner after keeping the photocopy of the same.
