--- 05 / 09.04.2025 All these bail applications arise out of the same police station. As such, they are being disposed of by a common order. Heard the parties. 2. Petitioners have been made accused in connection with Tandwa P.S. Case No. 259 of 2024 for the offences registered under sections 140(2), 3(2) of the Bharatiya Nyaya Sanhita, 2023 and subsequently added sections 103(1), 109, 238, 61(2) of the Bharatiya Nyaya Sanhita, 2023, pending in the court of Sri S.S. Tirkey, learned Judicial Magistrate, 1st Class, Chatra. 3. On 29.08.2024 at 7.00 p.m., son of the Informant namely Akash Kumar Sao and one Hemraj Sao were kidnapped by unknown persons. Kidnappers demanded ransom for their release. It appears that the accused persons inflicted
2. several knife blows on the victim Akash Kumar Sao while another victim Hemraj Sao was murdered. 4. As far as the petitioner Amit Kumar @ Golu is concerned, learned A.P.P submitted that apart from confession, there is no other material against him. 5. As far as the petitioners Deepak Sahu @ Dipak Sahu and Dhanu Paswan @ Praveen Paswan @ Praveen Kumar are concerned,, the victim Akash Kumar Sao has stated about their complicity in his statement recorded under section 183 of the B.N.S.S. He has stated that Dhanu Paswan who is one of the kidnappers had talked to the petitioner Deepak Sahu and co-accused Vicky Paswan seeking instruction as to what should be done with the victims, on which, Deepak Sahu and another accused Vicky Paswan told Dhanu Paswan to commit their murder. The victim Akash Kumar Sao was inflicted several knife blows and was left in nearby forest while the dead body of Hemraj Sao was recovered later on and his head was severed. 6. Considering the nature of allegation, I am not inclined to enlarge the petitioners Deepak Sahu @ Dipak Sahu and Dhanu Paswan @ Praveen Paswan @ Praveen Kumar on bail. Accordingly, their prayer for bail stands rejected. 7.
As far as the petitioner Amit Kumar @ Golu is concerned, I am inclined to enlarge him on bail. Accordingly, the petitioner- Amit Kumar @ Golu is
directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of Sri S.S. Tirkey, learned Judicial Magistrate, 1st Class, Chatra in connection with Tandwa P.S. Case No. 259 of 2024.
