Lingapalem Mandal, West Godavari District, without following due process of law, as illegal, arbitrary and violative of Articles 14, 21 and 300-A of the Constitution of India, apart from violative of principles of natural justice, consequently direct the respondents not to dispossess the petitioner from his lands to an extent of Ac.0-06 cents out of total lands to an extent of Ac.1-20 cents situated in Sy.No.23/6B, 23-7, 38/3 and 47-1 situated at Ganapavarigudem Village, Lingampalem Mandal, West Godavari District, in excess of the already acquired lands of Ac.0-60 cents in Sy.No.23/7 and Sy.No.23/6B, situated at Ganapavarigudem Village, Lingapalem Mandal, West Godavari District, except in accordance with law, IA NO: 1 OF 2020 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to grant stay of dispossession of the petitioner from his lands to an extent of Ac.0-06 cents, out of total lands to an extent of Ac.1-20 cents in situated in Sy.No.23/6B, 23-7, 38/3 and 47-1 situated at Ganapavarigudem Village, Lingampalem Mandal, West Godavari District, in excess of the already acquired lands of Ac.0-60 cents in Sy.No.23/7 and Sy.No.23/6B, situated at Ganapavarigudem Village, Lingapalem Mandal, West Godavari District, pending disposal of the main Writ Petition IA NO: 1 OF 2021 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to vacate the interim order dt 26-05-2020 in WP.No.8648/2020 and dismiss the writ petition and pass such other order or orders as this Counsel for the Petitioner:

The Court made the following ORDER:
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue appearing for the respondents. 2. This writ petition was filed questioning the action of the 3rd respondent in trying to dispossess the petitioner from his lands to an extent of Ac.0.06 cents out of total lands to an extent of Ac.1.20 cents situated in survey Nos.23/6B, 23-7, 38/3 and 47-1 situated at Ganapavarigudem Village, Lingampalem Mandal, West Godavari District, in excess of the already acquired lands to an extent of Ac.0.60 cents in survey Nos.23/7 & 23/6B, situated at Ganapavarigudem Village, Lingampalem Mandal, West Godavari District, without following the due process of law. 3. On the other hand, the learned Assistant Government Pleader appearing for the respondents, relying upon the counter of the 3rd respondent, submits that the respondent authorities concerned are not interfering with the petitioner’s possession with respect to the subject land to an extent of Ac.0.06 cents out of total lands to an extent of Ac.1.20 cents situated in survey Nos.23/6B, 23-7, 38/3 and 47-1 situated at Ganapavarigudem Village, Lingampalem Mandal, West Godavari District. 4. In view of the above said facts and circumstances, no further orders are necessary in this writ petition. 4 BKM,J
