Petitioners-defendants have preferred instant civil writ petition under Article 227 of the Constitution of India, impugning the interlocutory order dated 13.01.2025 passed by the Court of Additional District and Sessions Judge No.3, Jaipur Metropolitan- II, Jaipur, in Civil Suit No.37/2013, dismissing petitioners’ application filed under Section 151 CPC, declining to permit the petitioner-defendant No.1-Mohammad Ishaque to produce his evidence. 2. Having argued the writ petition for some time and in view of the fact that the suit is at the stage of final hearing and listed today itself before the trial Court, counsel for the petitioners seeks permission to withdraw the writ petition with liberty to assail the impugned order at the Appellate stage, if occasion so arises. 3. In view of above, without interfering with the impugned order, the writ petition is disposed of with the liberty as prayed for. 4. All pending application(s), if any, stand(s) disposed of.
