1. By way of the instant petition, the petitioner is challenging the notice dated 16/07/2025 (Annexure P/1) issued by the Rent Control Officer, Raipur whereby the Tehsildar has been directed to hand over the vacant possession of the house situated in front of Sunil General Store, Pritam Nagar, Gudhiyari, Raipur to the Respondent No.3.

Learned counsel for the petitioner would contend that the petitioner has purchased the said house situated at land bearing Khasra ASHUTOSH MISHRA Digitally signed by ASHUTOSH MISHRA Date: 2025.09.16 18:37:16 +0530
2 / 2 No.434/22 and 435/20 from Respondent No.4 for a sale
consideration of Rs.3,50,000/- and the petitioner was given the vacant possession of the same and a written agreement has been executed in this regard on 04/03/2021 with the Respondent No.4 and the petitioner is in peaceful possession of the said house. He would next contend that the petitioner has not executed any rent agreement with the Respondent No.3 or anyone else in respect of the said house.
3. Per contra, learned State counsel opposes the submissions of the petitioner and would submit that the instant writ petition is not maintainable on account of availability of alternative remedy to the petitioner.
4. I have heard learned counsel for the parties and perused the documents with utmost circumspection.

Considering the entire facts and circumstances of the case, the instant writ petition is not maintainable in view of the availability of the alternative remedy for filing appropriate appeal before the Rent Control Appellate Tribunal and the petitioner, if so advise, may avail the same and may also raise all the objections therein.
