After arguing the matter at length, learned counsel for the petitioners has contended that the present petition may be dismissed with liberty to the petitioners to challenge the order dated 01.04.2025 passed by the Rent Authority in an appropriate proceeding in case the Rent Authority decides the Case No.878 of 2022 (Smt. Neelam Rupauliha Vs. Abdul Saboor and Others) against the petitioners. In the instant case, the petitioners have preferred the appeal against the order dated 01.04.2025 before the Rent Tribunal and the appeal of the petitioners was rejected on the ground that the appeal of the petitioners is not maintainable being preferred against an interim order. The merit of the aforesaid order has not been tested so far. Accordingly, the petition is dismissed with liberty to the petitioners to challenge the order dated 01.04.2025 in Case No. 878 of 2022 (Smt. Neelam Rupauliha Vs. Abdul Saboor and Others) in an appropriate proceeding in case the Case No. 878 of 2022 is decided against the petitioners.
