2. Petitioner has been made accused in connection with Lesliganj P.S. Case No. 82 of 2024 for the offences registered under sections 189(4), 189(5), 190, 191(2), 191(3), 125, 126, 127, 115(2), 109, 132, 117(2), 285, 221, 324(5), 324(6) and 326 of the Bharatiya Nyaya Sanhita, 2023 and section 3 (2) (D) of the Prevention of Damage to Public Property Act, pending in the court of Smt. Shikha Agrawal, learned Judicial Magistrate, Palamau.
3. On 15.07.2024 at about 1.30 p.m., a bus bearing registration no. JH 03Y 5971 dashed a Tempo, due to which, two passengers died and several co-passengers were injured. It is alleged that a mob of 500 persons set the bus on fire and assaulted the driver, due to which, he succumbed to his injuries.
4. It was submitted that there is general and omnibus allegation against all the accused persons. It was further submitted that similarly situated co-accused persons have been granted bail by this court earlier.
5. Mr. Vishwanath Roy, learned Special P.P has opposed the prayer for bail, but does not dispute the aforesaid facts.
6. In view of the submission made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is
directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of Smt. Shikha Agrawal, learned Judicial Magistrate, Palamau in connection with Lesliganj P.S. Case No. 82 of 2024.
