THE HONOURABLE SRI JUSTICE RAVI NATH TILHARI THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM WRIT PETITION NO: 27899/2025 ORDER: (per Hon’ble Sri Justice Ravi Nath Tilhari) Heard Sri D.S.Sivadarshan, learned counsel for the petitioner and Sri Bolla Venkata Rama Rao, learned Standing Counsel for the respondents 2 to 4. 2. This writ petition was filed by the petitioner seeking the prayer to issue direction more particularly in the nature of writ of Mandamus directing the respondents to dispose of application No.4095727 submitted for Consent To Operate Common Bio- Medical Waste Treatment Facility. 3. The 3rd respondent has filed counter-affidavit inter alia submitting in para-11 that the entire process will be completed within six weeks by following due procedure and adhering to the relevant guideline disposing of the petitioner’s application. Para-11 of the counter-affidavit reads as under: <It is to submit that, in the above mentioned circumstances, APPCB will take appropriate decision on permitting the establishment of Common Bio-Medical Waste Treatment Facilities (CBWTFs) in the coverage areas where there is 2 inadequacy i.e. a second facility is required for collection, storage, transportation, treatment and disposal of Bio medical waste in the erstwhile East Godavari District ( including proposed coverage area of the petitioner applied for Common Bio Medical Waste Treatment and Disposal Facility (CBWTF) based on the Gap Analysis report & Action Plan, which will be authorized following due procedure adhering to the Revised Guidelines for development of new CBWTFs issued by the CPCB. It will be completed within six weeks of time. Therefore, this respondent will dispose of the petitioner application within six weeks time.= 4. In view of the aforesaid stand taken up by the respondents, learned counsel for the petitioner submits that for the present cause does not survive any longer as the respondents have undertaken to dispose of the application within the specified period. 5. Sri Bolla Venkata Rama Rao, learned Standing Counsel for the 2nd respondent submits that within a period of six weeks, the application of the petitioner would be disposed of. 6. Recording the aforesaid, this writ petition is being disposed of finally with a direction to the respondents 2 to 4 to consider and dispose of the petitioner’s application on the subject in accordance with law with due opportunity within a period of six weeks from the date a copy of this order is produced before the said respondents. 7.
