The learned counsel for the petitioners submitted that the trial Court is not proceeding further adjourning the petition under section 89 of C.P.C. 3. In a decision of the Supreme Court between Sangram Sadashiv Surya Vanshi Vs. State of Maharashtra1 in which the Supreme Court determined the practice of the High Court to give direction to the trial Court to dispose of the cases by fixing time in paragraph 7 of the judgment reads thus: “47.3 Constitutional courts, in the ordinary course, should refrain from fixing a time-bound schedule for the disposal of cases pending before any other courts. Constitutional courts may issue directions for the time- bound disposal of cases only in exceptional circumstances. The issue of prioritising the disposal of cases should be best left to the decision of the courts concerned where the cases are pending;” 4. Since, it is the matter to be represented before the trial Court for early disposal, subject to the other works pending before the Court wherein the petition is disposed of directing the petitioners to make appropriate representation before the trial Court. There shall be no orders as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this civil revision petition shall stand closed. ___________________ ___ JUSTICE B.S.
