Heard Sri Kondaveeti Ravi, learned Senior Counsel representing Sri Adapa Ramya Sahithi Naidu, learned counsel for the petitioner and Smt. Sudeepthi Potluri, learned Assistant Government Pleader for Mines and Geology appearing for the respondents. 2. Challenging action of the respondents in not considering the case of the petitioner for allotment of mining lease in respect of land in Sy.No.865 admeasuring Ac.81.50 cents situated at Veldurthy Village and Mandal, Kurnool District and not considering the representation of the petitioner dated 27.08.2024, the present writ petition is filed. 3. It is contended that the petitioner has made a representation to the respondents seeking the grant of mining lease, since the preferred bidder in the e-auction conducted by the department did not deposit the requisite amounts within the stipulated period. The petitioner further contends that the petitioner was not permitted to participate in the said e-auction. Since the petitioner during his lease period, had developed the mining area and established infrastructural facilities to the subject mining area, through the instant representation requested for allotment of mining lease, as the preferred bidder did not submit the required mining plan and obtain approval from the Pollution Control Board. 4. Having regard to the contentions advanced, as the relief sought by the petitioner against the respondents is inaction in considering the representation of the petitioner dated 27.08.2024, this Court deems it appropriate to dispose of the writ petition directing the respondents to dispose of the representation of the petitioner. However, the learned Assistant Government Pleader for Mines and Geology submits that the representation of the petitioner is not addressed, to the appropriate authority. 5. Having regard to the same, this Court deems it appropriate to dispose of the writ petition granting liberty to the petitioner to file a detailed representation before the 1st respondent within a period of two weeks from the date of receipt of a copy of this order.
Upon filing of such representation, the 1st respondent shall consider and dispose of the representation, in accordance
with law, within a period of six weeks thereafter, after providing due opportunity of hearing to the petitioner. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
