This is First bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.469/2024 registered at Police Station- Bhilai Nagar, District - Durg (C.G.), for the offence punishable under Sections 318(4) read with Section 3(5) of BNS, 2023 and Section 66(D) of Information Technology Act. 2. The prosecution story in brief, is that a written report was made by the complainant Indra Prakash Kashyap to the police on 16.11.2024 VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.11.13 11:34:36 +0530 2 to the effect that the applicant along with other five accused persons stating themselves to be authority of T.R.A.I Adhar Card has been used in a crime and on threat of implication in the crime, took amount of Rs.49,01,196/- from the complainant. Therefore, FIR has been lodged against the applicant. 3. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case and further submits that there was six accused persons involved in the present case and main accused person namely Manoj Vishwanath Pal is absconding and bail application filed by other co-accused namely Bapu Shridhar Bharad was rejected by this Court in MCRC No.1298 of 2025 vide order dated 21.02.2025, but during the course of trial there was compromise took place between the complainant and him, account of which he has been acquitted by the learned trial Court. He further submits that the bail application filed by the two co-accused namely Sheikh Naveed and Somnath Machind Doble have also been rejected by this Court in MCRC No.3639 of 2025 and MCRC No.369 of 2025 vide order dated 09.05.2025 and 21.02.2025 respectively. A copy of the said orders are annexed with the bail application. It is further submitted that the charge-sheet has been filed in this case. The applicant is in jail since 09.06.2025 and trial is likely to take quite long time for its conclusion, therefore, he prays for grant of bail. 4. On the other hand, the learned State counsel opposes the bail application and submits that the charge-sheet has been filed in this case. It is further submitted that the applicant committed a digital fraud with the complainant for an amount of Rs.49,01,196/-. As such, itself shows commission of a serious crime, further the bail application of the co-accused persons, namely Somnath Machind 3 Doble and Bapu Shridhar Bharad has been rejected by this Court vide order dated 21.02.2025 passed in MCRC No.369 of 2025 and MCRC No.1298 of 2025, hence the bail application of the applicant liable to be rejected, therefore, he is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused all of the documents available on record. 6. Taking into consideration the fact and circumstances of the case, submissions made by learned counsel for the parties, allegation levelled against the present applicant and considering the fact that co-accused persons, namely Somnath Machind Doble and Bapu Shridhar Bharad has been rejected by this Court vide order dated 21.02.2025 passed in MCRC No.369 of 2025 and MCRC No.1298 of 2025, thus this Court is of the view that it is not a fit case to release the applicant on bail. 7. Accordingly, the Third bail application of the applicant namely Bharat Kumar Menariya involved in Crime No.469/2024 registered at Police Station- Bhilai Nagar, District - Durg (C.G.), for the offence punishable under Sections 318(4) read with Section 3(5) of BNS, 2023 and Section 66(D) of Information Technology Act., is rejected at this stage. 8.
