JUSTICE PRAVEER BHATNAGAR Order 03/02/2025 1. The instant bail application has been filed under Section 483 B.N.S.S. on behalf of the accused-petitioners. The accused- petitioners have been arrested in connection with FIR No.284/2024 registered at Police Station Sadar Bayana, District Bharatpur for the offence(s) under Sections 189(2), 115(2), 126(2), 333 and 351(2) of B.N.S. 2. Learned counsel for the accused-petitioners submits that the accused-petitioner have falsely been implicated in this case. Prima facie no case is made out under Sections 115(2) and 126(2) of B.N.S. He further submits that the injured Jagdish has entered into compromise with the accused-petitioners and also submitted an affidavit containing the fact that the injuries sustained to his eye is an old one and he received injuries at his back only. It is also contended that he never received any injury on his eye. The (2 of 2) [CRLMB-1322/2025] accused-petitioners are in custody since long and trial of the case will take considerable time, therefore, considering the affidavit of the injured Jagdish, the bail may be granted to the accused- petitioners. 3. Learned Public Prosecutor vehemently opposed the bail application. 4. Learned counsel for complainant concedes that the injured Jagdish has entered into compromise with the accused-petitioners and submitted an affidavit to the fact that the injuries on his eye is an old one and not related to the incident. Learned counsel for the complainant has no objection if, this bail application of the accused-petitioners is allowed. 5. Heard and perused the material available on record. 6. Considering the above facts, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail. 7. Accordingly, this bail application under Section 483 B.N.S.S. is allowed and it is ordered that the accused-petitioners 1. Amrit Lal S/o Fatte 2.
