THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION No.855 OF 2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A2, seeking bail, in Crime No.240/2024 of II Town Police Station, Visakhapatnam Commissionerate. 2. A case has been registered against the petitioner and others for the offence under Section 20(b)(ii)(C) r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act. 3. Case of the prosecution is that on 15.9.2024 at about 5.00 p.m., on receipt of credible information regarding illegal possession and transportation of ganja, S.I of Police, along with staff, rushed to Pithanidibba, Visakhapatnam and found one male person with two bags and on seeing police, he tried to escape. Then police apprehended him and on interrogation, he disclosed his identity particulars and police found 23 kgs of ganja in his possession. He stated that he purchased the same from A2 i.e. the petitioner herein. Then police seized the ganja and the vehicle and arrested the A1 on 15.9.2024 and also arrested the petitioner on 04.11.2024. 4. Heard. Perused the record. 2 5. Learned Assistant Public Prosecutor submits that investigation is at nascent stage and some more witnesses are to be examined and the petitioner was involved in five cases of similar nature and prays to dismiss the criminal petition. 6. A perusal of the material available on record goes to show that 23 kgs of ganja was seized from the possession of A1 which is commercial quantity and that the petitioner was arrested on 04.11.2024. As stated by the learned Assistant Public Prosecutor, the investigation is at nascent stage and some more witnesses are to be examined. Hence, this Court is not inclined to grant bail to the petitioner/A2, at this stage. 7. Accordingly, the Criminal Petition is dismissed. _______________________ K.
