Mr. Sagar Kothari, learned counsel for petitioner. 2. Mr. S.C. Dumka, learned D.A.G. with Ms. Sweta Badola Dobhal, learned Brief Holder for the State of Uttarakhand/respondent Nos.1 and 2. 3. By means of the present criminal writ petition, petitioner has challenged the FIR No.106 of 2025 dated 21.03.2025 registered with P.S. Nehru Colony, District Dehradun, under Sections 106(1), 281 and 324(4) of B.N.S. Act. 4. From perusal of the FIR it transpires that the offences which have been alleged against the petitioner are bailable in nature, therefore, there is no apprehension of petitioner being arrested pursuant to the aforesaid FIR. 5. Learned counsel for the petitioner argued that the allegations levelled against the petitioner are frivolous. The petitioner took the deceased to hospital namely Kailash Hospital and no injury was inflicted on the head of the deceased and the deceased was heavily drunk and the cause of his death was extremely low blood pressure. He also argued that the deceased was not hit by petitioner’s car. 6. Though, the argument which has been raised by the learned counsel for the petitioner that the deceased-Rajkumar Prajapati was not hit by the petitioner’s car, 2025:UHC:2668 cannot be appreciated by this Court at this stage, because, in the FIR, clear cut offence is made out against the petitioner. 7. Having gone through the FIR impugned in the writ petition, this Court is of the view that prima-facie offence is made out against the petitioner, therefore, this Court doesn’t want to interfere in the present matter. 8. Accordingly, the present criminal writ petition is dismissed in-limine. 9. Pending application, if any, is extended till then.
