ORDER; The instant petition is filed under Section 482 of the Code of Criminal Procedure, 1973, by the Petitioners/Accused Nos.1 to 6, to quash the proceedings against them in FIR No.4 of 2018 on the file of CID, Andhra Pradesh, Amaravati for the offences under Sections 120B, 193, 198 420, 426, 468, 469 and 506 of Indian Penal Code.
2. Heard Sri Avinash Desai, learned Senior Counsel for Ms.Jyothi Ratna Anumolu, learned counsel for the Petitioners. Learned Senior Counsel , 406, 409, would submit that the present matter is squarely covered by the Orders passed by the High Court of Telangana at Hyderabad in CrI.P.Nos.14205 of 2013 and 2173 of 2014 quashing the proceedings in C.C.Nos.313 and 398 of 2013 respectively on the file of the Court of Special Judge for Economic Offices, City Criminal Courts, Hyderabad, which were registered on the same set of
facts alleged in the present crime. Learned Senior Counsel would further submit that the Petitioners herein are the subsequent purchasers and they have also discharged all the debts. Learned counsel would finally submit that, the present complaint, which is registered on the same set of facts that already decided by the High Court of Telangana, has to be quashed. 3. Learned Special Public Prosecutor for CID would submit that the Court may pass appropriate orders. were

4. Based on a private complaint lodged by Respondent No.2 herein before the Court of III Additional Chief Metropolitan Magistrate, Hyderabad, a case in Crime No.609 of 2013 on the file of Banjara Hills Police Station, Hyderabad was initially registered against the Petitioners/Accused Nos.1 to
6. Subsequently, in view of the bifurcation of the State of Andhra Pradesh, the case was transferred to CID, Amaravati and renumbered as FIR No.4 of 2018. As can be seen from the material placed on record, as rightly put by the learned Senior Counsel for the Petitioners, Respondent No.2 herein lodged
5. \ complaints against the Accused therein, based on the same set of facts which are alleged in the present crime and the same were quashed by the High Court of Telangana vide Common Order passed in CrI.P.Nos.14205 of 2013 and 2173 of 2014. Further, the earlier cases were registered for the offences under the Companies Act and also under IPC offences, whereas, the present complaint has been registered for IPC offences. Learned Special Public Prosecutor for CID did not raise any objection with regard to the contentions raised by the learned Senior Counsel for the

Considering the submissions and since the present case is squarely covered by the Common Order passed by the High Court of Telangana in CrI.P.Nos.14205 of 2013 and 2173 of 2014, continuation of proceedings against the Petitioners herein, on the same set of facts, which were already decided, is an abuse of process of the Court. In such circumstances, this
Court is of the view that it is a fit case to exercise the power under Section 482 Cr.P.C for quashment of the case against the Petitioners. 8.
In the result, the Criminal Petition is allowed and the proceedings against the Petitioners/Accused Nos.1 to 6 in FIR No.4 of 2018 on the file of CID, Andhra Pradesh, Amaravati for the offences under Sections 120B, 193 198, 406, 409, 420, 426, 468, 469 and 506 IPC, are hereby quashed.
