Learned Assistant Government Pleader Ms.Shrunjal Shah for the respondents has placed on record the letter dated 7th August, C/SCA/9801/2025 ORDER DATED: 08/08/2025 2025 addressed to the President/Secretary, Dipawali Co-operative Society Limited intimating that pursuant to the withdrawal of the charge by the respondent-Department as stated in the order dated 23rd January, 2025 passed by this Court in Special Civil Application No.111 of 2025, there is no objection for transfer of the property (in question) in name of the petitioner by the Society. 2.2. It was therefore submitted that in view of the above letter, the Society is free to transfer the property (in question) in name of the petitioner as there is no charge of the respondent-Department and there is no prohibitory order as far as the property (in question) is concerned, for transfer of the same in name of the petitioner. C/SCA/9801/2025 ORDER DATED: 08/08/2025 3. In view of the above development, learned advocate Mr.B.M.Mangukiya for the petitioner, under instructions, seeks permission to withdraw this petition at this stage with a liberty to revive in case of difficulty. Permission is granted. 4. The petition is accordingly disposed of as withdrawn. Civil Application is also disposed of in view of the disposal of the main matter. Direct service is permitted today.
