By means of the present writ petition, the petitioner is seeking indulgence of this Court for issue of writ of mandamus commanding respondent no.1 to conduct an enquiry thereby take appropriate action against respondent nos.5, 6 and 7 for illegally detaining the petitioner and thus usurping upon fundamental right of the petitioner guaranteed under Article 21 of the Constitution of India and further to pay compensation to the petitioner for his illegal detention.
4. From the record, it transpires that the petitioner was challan under Sections 116 and 117 of Cr.P.C. and he has been detained purportedly under Section 251 of Cr.P.C. and later on admittedly released on bail.
5. In view of the aforesaid facts, the writ petition appears to be highly misconceived as it cannot be claimed that he was detained illegally.
6. Accordingly writ petition stands dismissed in limine.
