This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: <…to pass an appropriate order or directions more particularly one in the nature of a writ of MANDAMUS declaring the action of the respondents in not registering the crime on orders of the learned trial court in CF/ Cr.MP.No.2301/2019 dated 25.06.2019 as arbitrary, illegal and violative of criminal procedure and consequently direct the respondents to register crime and investigate by adhering the learned court order forthwith and pass…=
2. Heard Sri Sai Gangadhar Chamarty, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader for Home.
3. Learned Assistant Government Pleader for Home brought to the notice of this Court that for the very same cause of action, the petitioner has filed a complaint before the learned III ACMM Court, Vijayawada. The same was forwarded to the Station House Officer, S.R.Peta Police Station, which was registered as Crime No.116/2017. By suppressing the said fact, the petitioner has once again approached the Court and filed a complaint, which was referred to the Police, S.R.Peta Police Station, and registered as Crime No.19/2020 for the very same cause of action dated 26.11.2014.
4. Recording the same, the Writ Petition is disposed of. There shall be no
order as to costs.
