The present bail application, seeking bail, has been moved by the accused-applicants-Harsh @ Badal and Ankit involved in Case Crime No.113 of 2025, under Sections 109, 3(5) B.N.S.2023 and 3/5/25/27 Arms Act, Police Station Khatauli, District Muzaffarnagar. 3. Learned counsel for the accused-applicants contends that accused-applicants have been falsely implicated in the present case during investigation. The F.I.R. is one day delayed, which is lodged against three anonymous persons with the allegation that on 17th March, 2025 three motorcycle borne accused came and started indiscriminate firing on him. No one is hurt, though indiscriminate firing is alleged in the F.I.R. CCTV footage does not suffix the clear picture. Later on, three accused have been roped. Sri Avnish Kumar Srivastava, learned counsel for the informant and learned A.G.A. have opposed the prayer for bail and submitted that there is specific role of the accused shown in the CCTV that three motorcycle borne miscreants came and started indiscriminate firing, though there is no one injured in the incident. There is ample evidence against the accused, who have already been charge-sheeted. 5. This Court has taken into consideration the rival submissions
made by learned counsel for the parties and perused the record which prima facie reveals that the F.I.R. has been lodged with delay of one day against anonymous persons.Charge-sheet has been submitted. There is no injury on the person of informant. The accused-applicants are languishing in jail since March, 2025. 6. Hence, without touching the merit of the case, the bail application is allowed. 7.
