GP FOR REVENUE (AP) The Court made the following: 3 THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI WRIT PETITION No.15725 of 2019 ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking the following relief: <to issue a Writ, Order or Direction, more particularly one in the nature of a Writ of Mandamus, declaring the action of the respondents in not transferring Crime No.119/2018 on the file of the 5th respondent to any other agency, including the C.B.I. or any other Station House Officer, for conducting a fair and proper investigation in pursuance of the representations submitted by the petitioner and also in the light of the communication of the 2nd respondent in Rc.No.5736/Compls-2/2018 dated 03-10-2018, as illegal, unjust, arbitrary, high-handed, mala fide and discriminatory and against statutory provisions; and consequently, to direct the respondents to transfer Crime No.119/2018 on the file of the 5th respondent to any other agency, including the C.B.I. or any other Station House Officer, to conduct a fair and proper investigation in pursuance of the representations of the petitioner and in the light of the communication of the 2nd respondent in Rc.No.5736/Compls-2/2018 dated 03-10-2018, and pass…= 4 2. Heard Sri L. J. Veera Reddy, learned counsel for the petitioner appearing virtually, and Sri R. Mallikarjuna Rao, learned Assistant Government Pleader for Home, appearing for respondent Nos.1 to 5. 3. Learned counsel for the petitioner, appearing virtually, submits that in view of the submission made by the learned Assistant Government Pleader that a report has been submitted vide M.C. No.17 of 2018 pending before the learned Mandal Executive Magistrate, Vempalli, YSR District, the writ petition may be closed, granting liberty to the petitioner to file a protest petition before the learned Magistrate in accordance with law. 4. Considering the above, the Writ Petition is closed at the stage of admission, without going into the merits of the case. The petitioner is at liberty to approach the concerned authority for necessary redressal in accordance with law.
