GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 21937 of 2023 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: <…to issue a writ, order or a direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in interfering with the civil disputes and threatening the petitioners to hand over the land situated in Sy.No.151/9 to an extent of Ac.2.03 cents of Tamaram Village, Makavarapalem Mandal, Anakapally District to unknown person/third parties is highly illegal, arbitrary, unconstitutional and violation of articles 14 and 300-A of the Constitution of India and consequently direct 3rd respondent not to insist to hand over the possession of the land situated in Sy.No.151/9 to an extent of Ac.2.03 cents of Tamaram Village, Makavarapalem Mandal, Anakapally District to third parties/unknown persons.…= 2. None represented for the petitioners. The grievance of the petitioners is that the respondent-police are interfering in the civil disputes between the petitioners and threatening to hand over the subject land to 3rd parties. 3. Sri P.Ajay Babu, learned Assistant Government Pleader for Home, by way of counter, would submit that basing on the complaint of one Sri. Appalachari Kommoju, through Spandana program, the 4th respondent registered a case in Cr.No.186 of 2023 under Sections 447, 427, 506, 420, 468, 471 r/w 34 of IPC registered against the petitioners who are A3 & A4. He would further submit that except for enquiry on the Spandana petition and the registration of the criminal case, the police never interfered in the civil disputes 4 and insisted the petitioners to hand over the possession of the subject land to the 3rd parties. 4. Recording the same, this Writ Petition is disposed of. However, the police are directed to follow due process of law regarding the crime registered against the petitioners. No order as to costs.
