refunding the amount of Rs. 1,02,307/- towards the value of the seized stock and Rs. 1,02,307/- towards the deposit made for interim custody of the seized vehicle in connection with case bearing No. Ref.V12/1036/2008 on the file of the 2nd Respondent under Section 6-A of Essential Commodities Act, 1955 even after the seizure was set aside by the Court of Sessions, East Godavari District, Rajamahendravaram in Criminal Appeal No.438 of 2014, Dated 07- 04-2016 as illegal, arbitrary and unjust and consequently direct the respondents to refund the amount of Rs.1,02,307/- towards the value of the seized stock and Rs.1,02,307/- towards interim custody of the seized vehicle in connection with case bearing No. Ref.V12/1036/2008 on the file of the 2nd Respondent under Section 6-A of Essential Commodities Act, 1955 in favour of the Petitioner Concern with 18 percent interest from the date of making the said deposits by the petitioner. Prayer is amended as per the Court Order dt 22.04.2024 vide orders passed in I.A.No.02 of 2024.
IA NO: 1 OF 2024 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the respondents herein to refund the amount of Rs. 1,02,307/- towards the value of the seized stock and Rs. 1,02,307/- towards the deposit made for interim custody of the seized vehicle in connection with case bearing No. Ref.V12/1036/2008 on the file of the 2nd Respondent under Section 6-A of Essential Commodities Act, 1955 forthwith, pending disposal of the present writ petition and pass IA NO: 2 OF 2024 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to permit the Petitioner to amend the prayer in W.P.No.2914 of 2024 by substituting the prayer therein as >>declaring the inaction of the Respondents in refunding the amount of Rs. 1,02,307/- towards the value of the seized stock and Rs. 1,02,307/- towards the deposit made for interim custody of the seized vehicle in connection with case bearing No. Ref.VI2/1036/2008 on the file of the 2nd Respondent under Section 6-A of Essential Commodities Act, 1955 even after the seizure was set aside by the Court of Sessions, East Godavari District, Rajamahendravaram in Criminal Appeal No. 438 of 2014, Dated 07-04-2016 as illegal, arbitrary unjust and consequently direct the respondents to refund the amount of Rs. 1,02,307/- towards the value of the seized stock and Rs. and 1,02,307/- towards interim
