This appeal under Section 173 of the Motor Vehicles Act, 1988 has been preferred by the appellants/ claimants seeking enhancement of the amount of compensation, challenging the impugned award dated 13.12.2022 passed by learned Motor Accident Claims Tribunal, Jashpur in M.A.C.T. Case No.23/ 2022, by which the claim application of the claimants has been allowed and an amount of compensation to the tune of Rs. 13,67,984/- has been awarded to the claimants. 2. At the very outset, learned counsel appearing for the parties would submit that the appellants/claimants would be entitled for an additional amount of Rs. 22,000/- under the head of consortium along-with interest. 3. In view of the above submission, it is directed that the appellants/claimants are entitled for Rs. 22,000/- under the head of consortium in addition to the amount of compensation already awarded by the learned Claims Tribunal i.e. Rs. 13,67,984/-. Hence, the total amount of compensation comes to Rs. 13,67,984 + Rs. 22,000 i.e. Rs. 13,89,984/-. 3
4. The concerned respondent is directed to deposit the amount of compensation as enhanced by this Court within a period of 45 days. The additional amount of compensation shall also carry interest @6% per annum from the date of filing of claim application till its realization. Rest of the conditions of the impugned award shall remain intact. 5. Accordingly, this appeal is partly allowed and the impugned award is modified to the extent as indicated herein-above.
