MANNAM VENKATA KRISHNA RAO The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of the 3rd Respondent herein in interfering with matrimonial dispute H.M.O.P.No.34 of 2022 pending on the file of Senior Civil Judge Court, Dhone, Kurnool District and threatening to implicate the Petitioner and his family members in false Criminal Cases as arbitrary, autocratic, illegal, ultravires and against to the principles of 2 natural justice and consequently direct the Respondents 2 and 3 herein not to initiate false criminal cases without thorough inquiry against the Petitioner and his family members in the interests of justice.” 2. Sri I.Chandra Sekhar, learned counsel for the Petitioner would submit that the Police are interfering with the matrimonial disputes between the Petitioner and the unofficial Respondent. 3. Sri V.Farooq, learned Assistant Government Pleader for Home would submit that, in view of the interim order dated 26.09.2022 in I.A.No.1 of 2022 the Police are not interfering in the matrimonial dispute between the Petitioner and Respondent No.4 which is pending on the file of the Court of Senior Civil Judge, Dhone, Kurnool District in HMOP No.34 of 2022. 4. Considering the submissions made, the Writ Petition is disposed of. However, Police are directed not to interfere in the matrimonial dispute between the Petitioner and Respondent No.4 in HMOP No.34 of 2022 on the file of the Court of Senior Civil Judge, Dhone, Kurnool District, except under due process of law. There shall be no order as to costs.
