Tado, learned Additional Public Prosecutor for the State of Arunachal Pradesh. This interlocutory application is filed under Sections 430(1) of the BNNS, 2023 praying for suspension of the sentence as well as for releasing of the applicant on bail. The convict, Shri Lang Norbu, was convicted and sentenced on 27.08.2024 by the learned Special Judge, NDPS, Bomdila in NDPS Case No. 13/2023 under Sections 20(b)(ii)(C) of the NDPS Act and sentenced him to rigorous imprisonment for 10 years and payment of fine of Rs. 1,00,000/-. I have considered the submissions made by the learned counsel appearing for both the sides. I have gone through the impugned judgment and order and the FIR. It is hereby directed that the sentence imposed upon the applicant, namely, Shri Lang Norbu, by the learned Special Judge, NDPS, Bomdila in NDPS Case No. 13/2023 under Sections 20(b)(ii)(C) of the NDPS Act on 27.08.2024 shall remain suspended till the disposal of the connected appeal i.e. Crl.A. 35 (AP) of 2024. Page No.# 3/3 The applicant, Shri Lang Norbu, shall be release on furnishing a bail bond of Rs. 25,000/- with surety of like amount to the satisfaction of the learned Special Judge, NDPS, Bomdila.
