JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 7 02-05-2025 Heard Mr. Pravashankar Mishra, learned counsel appearing on behalf of the petitioner and Mr. Umeshanand Pandit, learned APP appearing on behalf of the State. 2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act. 3. As per prosecution case, it is alleged that this petitioner fired multiple gun shots on the informant due to which he sustained three gun shot injuries. 4. Learned counsel appearing on behalf of the petitioner submits that petitioner is quite innocent and has committed no offence. Informant is a person of dubious

As a matter of fact, informant had an in affair with co-accused Jagriti Kumari and in the meantime, informant was sent to jail and co- accused Jagriti Kumari and this petitioner became friends. Thereafter, when informant came out of jail, he started pressurizing co-accused Jagriti Kumari to meet him and leave this petitioner but she denied and in rage, informant implicated this petitioner and co-accused Jagriti Kumari in this false and concocted case. It is further submitted that on the alleged date and time of occurrence, this petitioner was not present at the place of occurrence and during course of investigation, tower location of mobile phone of this petitioner was found somewhere else. 5. On the other hand, learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for grant of bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he shot multiple fires upon informant as a result of which he sustained three gun shot injuries.
Doctor has found the injuries, sustained by the informant, to be grievous in nature. Petitioner has got two criminal antecedents. 6. Considering the specific and direct nature of
