Item No.15 24.09.2025 Court. No. 16 Cp/Gb CPAN/2005/2024 With IA NO: CAN/2/2025 in WPA/8988/2023 SUDIP SAHA VS AYESHA RANI A , IAS AND ANR Mr. Shakti Chakraborty Ms. Rituparna Das …… for the applicant. Mr. Supriyo Chattopadhyay Ms. Sayantanee Bhattacharjee ….for the alleged contemnors. The applicant is granted liberty to correct the error in the date. CAN 2 of 2025 is an application for restoration of CPAN 2005 of 2024, which was dismissed for default on August 19, 2025. Considering the averments made in paragraphs 6, 7 and 8 of the said application, the court is satisfied that the applicant was prevented by sufficient cause from attending the court on the date when the matter was called on. Accordingly, CAN 2 of 2025 is allowed. The contempt application is restored to its original file and number. 2 Mr. Chattopadhyay, learned advocate for the alleged contemnors, files a copy of the decision of the regulated market committee. It appears that the committee has permitted both the brothers to operate from the shops subject to conditions. The applicant is aggrieved by the said order. The applicant is at liberty to challenge the said order before the appropriate forum by taking out an appropriate application. Accordingly, the contempt application is disposed of and the contempt proceedings are dropped. (Shampa Sarkar, J.)
