Neutral Citation No. - 2025:AHC:66638-DB Court No. - 39 Case :- WRIT - C No. - 13049 of 2025 Petitioner :- Sunil Kumar And Another Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Akhilesh Kumar Singh,Om Shiv Counsel for Respondent :- C.S.C. Hon'ble Arindam Sinha,J. Hon'ble Avnish Saxena,J. Mr. Akhilesh Kumar Singh, learned advocate appears on behalf of petitioners and submits, his clients are in possession. Respondent no.6 is threatening to dispossess them. He seeks interference of Court to restrain said respondent and the administrative authorities (other respondents). Mr. Devesh Vikram, learned advocate, Additional Chief Standing Counsel appears on behalf of State. He submits, petitioners obtained mutation. Respondent no.6 preferred appeal, which was allowed. Petitioners then filed revision and it is pending. In the circumstances, the writ Court should not interfere. The matter regarding mutation necessarily involves recording the person who will pay the rates and taxes. It appears the Revenue Court is already in seisen of the matter, having admitted petitioners' revision on order dated 8th July, 2024 (disclosed at page 94). As such, we are not inclined to direct issuance of notice on private respondent. Instead, we observe that petitioners have to find their remedy from the Revenue Court. Mr. Singh submits, there be direction for the Revenue Court to expeditiously decide on his clients' revision. His submission stands recorded with liberty for his clients to produce certified copy of this order before said Court and pray for expeditious disposal. The writ petition is disposed of.
