Learned counsel for the applicant submits, however, as per allegation applicant and others by playing fraud grabbed the amount of life insurance of the husband of the informant but entire allegation leveled against the applicant is totally false. 4. She further submits, applicant is not even named in the FIR but surprisingly when the statement of one of the Jeth of the informant was recorded then he very casually stated that actually applicant also accompanied the other accused, who were named in the FIR. 5. She further submits, actually applicant is the brother-in-law of named accused Danish, therefore, during investigation he has also been made accused in the present matter. 6. She further submits, even except the bald and verbal allegation there is no cogent evidence of fraud and cheating against the applicant. 7. She further submits, however, applicant has also been challaned for offence under Section 111 B.N.S. i.e. organized crime but there is no evidence that applicant is either member of crime syndicate or he acted on behalf of such syndicate. 8. She further submits, applicant is not having any criminal history and in the present matter he is in jail since 04.03.2025. 9. Per contra, learned AGA opposed the prayer for bail but could not dispute the argument on facts advanced by learned counsel for the applicant. 10. I have heard learned counsel for the parties and perused the record of the case. 11.
From the record, it reflects, applicant was not named in the FIR but during investigation when the statement of one of the Jeth of the informant was recorded then he disclosed the name of applicant by stating that applicant also accompanied the other accused, who were named in the FIR and considering the manner in which applicant has been made accused, the argument advanced by learned counsel for the applicant cannot be ruled out with regard to his false implication specially considering the fact that applicant is brother-in-law of the named co-accused Danish. 12. Further, even there is no cogent evidence except the bald and verbal allegation against the applicant on record. 13. Further, there is no evidence that applicant was either member of any crime syndicate or acted on behalf of such syndicate. 14.
