ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
“….to issue an appropriate writ or direction, more particularly a Writ in the nature of Mandamus declaring inaction of the respondent Nos.2 and 3 in registering the FIR pursuant to the complaints dt.16.07.2019 is illegal, arbitrary and unconstitutional and consequently direct the respondent Nos.2 and 3 forthwith to register the FIR against the respondent Nos.4 and 5 and be please, and to pass…”
2. None appeared for the petitioner. 3. Learned Assistant Government Pleader for Home on written instructions would submit that basing on the report received from the writ petitioner, police registered a case in Crime No.179 of 2019 of Kovvur Police Station for the offence under Section 379 IPC on 09.08.2019, pending the writ petition. 4. The writ petition is filed alleging that police did not register any case in pursuance of the report presented by the writ petitioner. 5. Now, the instructions received by learned Assistant Government Pleader for Home would disclose that police already registered a case, basing on the report presented by the writ petitioner. 6. In that view of the matter, no further orders are required in the writ petition and the writ petition has become infructuous. 4
7. Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
