ML.42 15.01.2025 Court No.35 S. Gayen WPA 30337 of 2024 Sri Tapan Kumar Jana Versus The State of West Bengal & Ors. Mr. Sukanta Das …for the Private Respondent. Mr. Amal Kumar Sen, ld. AGP Ms. Ashima Das (Sil) …for the State. 1. The petitioner has approached this Court as the harvested crops have been ruined by the private respondent by dumping wastes and spreading pesticides in the agricultural land. The petitioner also alleges that the respondents threatened of dire consequences and in spite of several representations advanced to the police authorities, no action has been taken. 2. Learned advocate for the State has submitted a report. The report reflects that the local police station has registered a case being Kharagpur Local PS Case No. 1100/2024 dated 23.12.2024 against the respondent. The report also reflects that the private respondent filed a Title Suit 2 No.475 of 2022, wherein the learned Civil Judge (Senior Division), 3rd Court, Paschim Medinipur was pleased to pass an ad interim injunction. 3. Having regard to the fact that already the Criminal Court and the Civil Court have seen the matter in respect of the dispute, I am of the view that further interference by this Court is unwarranted. However, having considered that the petitioner and private respondent are at loggerhead, the police authorities would keep a strict vigil and would ensure that no breach of the peace takes place and/or any untoward incident results because of the inimical relationship between the petitioner and the private respondent. 4. With the above observations, WPA 30337 of 2024 is disposed of. 5. The report submitted by the State be kept on record. A copy of the report be submitted to the learned advocate appearing for the petitioner. 6. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
