Respondent Petition under Section 528 of BNSS is filed praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to relax the bail condition No.2 i.e. that “the petitioner shall appear before the Station House Officer concerned, once in a week, till filing of the Charge sheet” imposed by this Honorable Court in CrI.P No.4233 of 2025 vide its Order Dt; 30-06-2025 to the petitioner/ accused. The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and the order of the High Court dated 30-6^- 2025 made in CrI.P No.4233 of 2025 and upon hearing the arguments of SRI G RAMA GOPAL Advocate for the Petitioner/Accused and PUBLIC PROSECUTOR for the Respondent/Complainant, the court made the following ORDER “Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. The learned Assistant Public Prosecutor submits that the petitioner is regularly complying with the conditions, but the charge sheet has not been filed. For the reasons stated in the accompanying affidavit filed in support of the petition, the condition imposed on the petitioner herein vide orders in Crl.P.No.4233 of 2025 dated 30.06.2025 to appear before the Station House Officer concerned, once in a week, till filing of the charge sheet, is hereby relaxed. However, the petitioner shall make himself available to the Investigating Officer as and when required till filing of the charge sheet. Accordingly, the I.A.No.3 of 2025 is allowed.
