1. The applicant has preferred this First Bail Application under
2 Section 483 of BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 207/2020, registered at Police Station Tarbahar, District- Bilaspur (CG) for the offence punishable under Sections 302, 506 and 294 of IPC. 2. The prosecution story in brief, is that, on 09.10.2020, an FIR was lodged by one Akash Shankar, alleging therein that his brother, namely Rahul Shankar/applicant is a habitual drinker and used to quarrel with his father/deceased namely, Arun Shankar in demand of money to buy liquor. On 08.10.2020 when he was out for some work, he received a call from his friend namely, Zahir Mohammad who told him that his father is lying unconscious near the office one Vijay Singh at Contraction’s colony, immediately he rushed to the spot and took him to the hospital, where he was referred to KIMS Hospital, Bilaspur and subsequently on 13.10.2020 his father died during his treatment. 3. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. The applicant has no role to play in commission of the alleged offence. There is no legal material or evidence available on record constituting any offence as alleged by the prosecution. The applicant was absconded for about 4 years. The applicant is in jail since 28.01.2024 and conclusion of the trial will take some time. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail
3 application and submits that all the evidences are against the applicant. 5. I have heard learned counsel for the parties and perused the case diary. 6.
Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy, this Court is of the opinion that the applicant has committed murder of his father and was absconded for about 4 years. Therefore, it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant- Rahul Shankar involved in Crime No. 207/2020 under aforesaid sections at Police Station- Tarbahar, District- Bilaspur, Chhattisgarh, is rejected. 7. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment.
