Respondent(s) For Petitioner(s) : Mr. Ankush Gupta, Advocate For Respondent(s) : Hon’ble Shri Justice Arvind Kumar Verma, Judge Order on Board 30/10/2025 1. The petitioner has filed the present petition under Section 528 of the BNSS, 2023 being aggrieved by the impugned order dated 31.07.2025 passed by the learned Judicial Magistrate First Class, Raipur, District- Raipur (C.G.) in Complaint Case No. 8151/2019 whereby the learned trial Court has rejected the application under Section 311 of Cr.P.C. of the petitioner and closed the cross examination of complainant. 2. Learned counsel for the petitioner contended that despite of insufficient balance in her account, the respondent issued cheque 2 in favour of the complainant, hence said cheque was dishonoured which is against the provision of the Negotiable Instrument Act. He further contended that the learned trial court committed an error by overlooking the evidence of complainant, wherein he and witnesses specifically deposed that the respondent has committed the offence and there is corroboration in their statement. 3. Heard learned counsel for the petitioner and perused the record with utmost circumspection. 4. The present petition has been filed against the impugned order dated 31.07.2025 passed by the learned Judicial Magistrate First Class, Raipur, District- Raipur (C.G.) in Complaint Case No. 8151/2019, whereby the learned trial Court has rejected the application under Section 311 of Cr.P.C. and closed the cross- examination of complainant. 5. The relevant portion of the impugned order dated 31.07.2025 reads as under: "अवलोकन से दर्शित है किक परिवादी द्वाा यह परिवाद आोपी के किवरूद्ध धाा 138 पाक्रम्य लिलखत अधिधकिनयम के अंतर्ग$त पे किकया है। 6. From perusal of the impugned order, it is crystal clear that documents exhibited in the case are documents submitted by the complainant herself, and the complainant should have been provided with a list of witnesses to prove them. However, the complainant omitted this information. The complainant has been provided numerous opportunities to testify but the complainant made no attempt to summon the witnesses. Therefore, there is no illegality or infirmity in the order passed by the learned trial court. 7. In view of the above, the present petition is dismissed on merits.
