Petitioner has sought quashing of FIR No. 28 of 2021 registered against him for offence punishable under Section 376 IPC, at Police Station Jhankayiya, District Udham Singh Nagar. 3. Learned State Counsel, on instructions, submits that evidence collected during investigation was not found sufficient to file charge sheet against the petitioner, therefore, Closure/Final Report was submitted. Thus, he submits that challenge to the FIR has now become infructuous upon filing of Closure/Final Report. 4. Learned counsel for the petitioner also does not dispute the said submission. 5.
