Mr. Jitendra Chaudhary, learned counsel for the Petitioner.
2. Mr. Deepak Bisht, learned DAG, for the State of Uttarakhand/1 and 2.
3. Ms. Rajni Supyal Latwal, learned counsel for the HDFC Bank/Respondent Nos.3 and 4.
4. The instant writ petition has been preferred by the Petitioner with the following reliefs:-
“(i) Issue a writ, order or direction in the nature of Certiorari, calling for the original record and pleased to quash the impugned letter dated 30- 04-2025 (Annexure No.1) written by the Inspector Incharge Kotwali Jawalapur District Haridwar (Respondent No. 2) to the respondent no.3/the Branch Manager HDFC Bank Branch Near Ranipur Mod Haridwar along with the subsequent impugned two letters dated 02-09- 2025 & 26-09-2025(Annexure No.2 & 3) passed by the respondent no. 3 i.e. the Branch Manager HDFC Bank Branch Near Ranipur Mod Haridwar.
(ii) To issue order or direction in the nature of mandamus directing and commanding the respondent no. 2 & 3 {SHO Jawalapur as well as Branch Manager HDFC Branch Near Ranipur Mode Haridwar} to defreeze the bank account of the petitioner forth with and permit him to operate his account no.50100754032959 of HDFC Bank Branch Hapur District Hapur (U.P.).
(iii) Or pass any other order or direction which
this Hon'ble Court may deem fit and proper circumstances of the case.”

Learned counsel for the Petitioner submits that Respondent Nos.2 and 3 may be directed to defreeze the bank account of the petitioner forthwith and permit him to operate his account in the Bank.

Learned counsel for the Petitioner has placed reliance on a judgment passed by this Court in the case of
“M/s Satish Industries and another Vs. State of Uttarakhand and others” wherein, a similar relief has been sought for defreezing the bank account and it was granted.
7. After hearing the learned counsel for the parties, this Court is of the view that freezing of the account of the Petitioner is absolutely illegal and as such the instant petition deserves to be allowed.

Consequently, the instant writ petition is allowed, a writ of mandamus is issued to the Respondent Nos.2 and 3 i.e. {SHO Jawalapur as well as Branch Manager HDFC Branch Near Ranipur Mode Haridwar}, to defreeze the bank account of the Petitioner forthwith and permit him to operate his account no.50100754032959 of HDFC Bank Branch Hapur District Hapur (U.P.). No order as to costs.
