Appellant-convict has filed this criminal appeal to challenge the judgment of conviction and order of sentence dated 27.3.2025 passed by Chief Judicial Magistrate, Etah in Criminal Case No. 9922 of 2020, titled State Vs. Devendra Singh and others, arising out of Case Crime No. 585 of 1998, under Section 193, 420, 467, 468, 471,120-B I.P.C., registered at Police Station Kotwali Nagar, District Etah, thereby convicting the appellant under Sections 193, 420, 467, 468, 471 I.P.C., followed by imposition of sentence of five years, under Section 193 I.P.C. with fine of Rs.3,000/-; five years, under Section 420 I.P.C. with fine of Rs.3,000/-; seven years, under Section 467 I.P.C. with fine of Rs.5,000/-; five years, under Section 468 I.P.C. with fine of Rs.3,000/-; five years, under Section 471 I.P.C. with fine of Rs.3,000/-, with a further condition that in the event of non deposit of fine(s), convict shall undergo further imprisonment of one year. Learned counsel for the appellant states that erroneously the appeal against the judgment of conviction and order of sentence dated 27.3.2025 passed by the Chief Judicial Magistrate, Etah has been filed before this Court, instead of before the Sessions Court. Learned counsel prays for withdrawal of the appeal to avail the appropriate statutory remedy. The appeal is dismissed as withdrawn.
