GP FOR CIVIL SUPPLIES The Court made the following: 3 VS,J W.P.No.34458 of 2025 ORDER: The present writ petition came to be filed under Article 226 of the Constitution of India seeking the following relief: <…to issue writ direction preferably writ of mandamus declaring the action of the 3rd respondent in not appointing the petitioner as Fair Price Shop Dealer on compassionate grounds in respect of FP Shop No.0439011 of Ramachandrapuram Town and Mandal of B.R. Ambedkar Konaseema Dist., pursuant to the G.O.Ms.No.4 dt 28.2.2014 due to demise of his mother, who worked as Permanent Fair Price Shop Dealer for the subject shop, by finalizing the application submitted by the petitioner on 15.9. 2025 as illegal, arbitrary, and violative of principles of natural justice and consequently direct the respondents to appoint the petitioner as permanent FP Shop dealer for the subject shop on compassionate grounds, ….= 2. The case of the petitioner is that initially the petitioner’s mother Smt.Vasam Varala Lakshmi was appointed as a permanent Fair Price Shop dealer in the year 2010 for Shop No.0439011, Ramachandrapuram Town and Mandal, B.R.Ambedkar Konaseema District. Unfortunately, the petitioner’s mother died on 17.08.2024, leaving behind the petitioner, his father and his sister as her legal heirs. The petitioner’s father, being aged about 50 years, is not eligible for consideration on compassionate grounds. Likewise, the petitioner’s sister is married and leading her matrimonial life with her husband and is not interested in claiming the subject shop. Consequently, the petitioner submitted an application to the 3rd respondent on 15.09.2025, seeking appointment as Fair Price Shop Dealer on compassionate grounds in pursuance of G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies (CS-I) Department, dated 28.02.2014. As no orders have been passed on the said representation made by the petitioner on 15.09.2025, the petitioner is constrained to file the present writ petition. 4 VS,J W.P.No.34458 of 2025 3. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies. 4. Learned Assistant Government Pleader for Civil Supplies, on oral instructions, has stated that the representation made by the petitioner on 15.09.2025 is still pending for enquiry before the 3rd respondent herein and as such requested this Court to dispose of the writ petition by directing the 3rd respondent to complete the enquiry within a specified period. 5. In view of the above, the Writ Petition is disposed of, directing the 3rd respondent to pass appropriate orders on the representation submitted by the petitioner on 15.09.2025 in accordance with G.O.Ms.No.4, Consumer Affairs, Food and Civil Supplies (CS-I) Department, dated 28.02.2014, after duly conducting an enquiry as required under the Control Order, 2018 and to pass appropriate orders as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of a copy of this order. The petitioner is also at liberty to submit a No Objection Certificate of his sister before the 3rd respondent during the course of the enquiry. There shall be no order as to costs.
