This is the first bail application filed under Section 483 of the Bhartiya Nagrik Shuraksha Sanhita for grant of regular bail to the applicant who has been arrested on 21/05/2025 in connection with Crime No. 507/2025, registered at Police Station City Kotwali Balodabazar, District ASHUTOSH MISHRA Digitally signed by ASHUTOSH MISHRA Date: 2025.11.17 18:45:00 +0530

The case of the prosecution in brief is that the present applicant committed forceful sexual intercourse with the victim knowing that she was a minor and because of that she got pregnant and even the victim committed suicide by hanging. Thereafter, the report was lodged and the present applicant was arrested.

Learned counsel for the applicant would submit that the victim was in relation with the applicant which would be evident from the statement of victim’s mother PW-3. He would next contend that no document has been produced with regard to birth of the deceased/victim. He would next contend that there is no previous antecedent to the credit of the present applicant. He would lastly contend that the applicant is a young boy who is in jail since 21/05/2025 and if kept in jail for a long period, the same would ruin his carrier and life, therefore, he may be enlarged on bail.
4. Per contra, learned State counsel opposes the prayer for grant of bail.
5. The complainant appeared through VC from DLSA, Balodabazar and she objected for grant for bail to the applicant.
6. I have heard learned counsel for the parties and perused the documents.
7. Considering the entire facts & circumstances of the case and the nature & gravity of offence as it is a case of rape with minor and suicide, therefore, I am not inclined to release the applicant on bail.

8. Accordingly, the bail application is rejected. However, learned trial Court is directed to expedite the trial.
