The Court made the following Order:
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondents Nos.2 to 4 herein in not considering the petitioner's representations dated 08.03.2022, 13.12.2017, 15.12.2017 and 28.12.2017 respectively requesting them to pay the enhanced rents along with the arrears since 2015 onwards till date, for the premises bearing D.No.(Old) 45/53 (new) D.No.45/46 in Sy.No.2201/4 to an extent of Ac.0-4 1/10 cents or 1923 sq.feet situated at T.Sundupalli village and Mandal, YSR Kadapa District. 3. The learned counsel for the petitioner submits that the respondents may be directed to clear the dues if any and continue to pay the future rents within time. 4. On the other hand, the learned Assistant Government Pleader relying upon the counter of the 4th respondent and the written instructions of the 4th respondent dated 07.11.2025 submits that the payment of rental arrears @ Rs.2.50/- per Sq.Ft i.e., Rs.4,808/- per month from 01.03.2017 to 31.01.2018 and the pending arrears @ Rs.6.00 per Sq.ft. i.e., Rs.11,538/- per month from 01.02.2018 to 30.09.2022 were calculated and were paid as under:- Sl.No. Period Rate per 1 Sq.ft Total area Net rent to be paid in Rs. The 4th respondent initiated action for payment of an amount of Rs.12,12,616/- including an amount of Rs.50,000/- towards advance to the petitioner towards rental dues till date and there was no pending rental dues as on the date for the occupied building premises of the office of the 4th respondent. Whereas the petitioner is demanding for payment of rental dues with effect from 01.03.2016, but the Government has revised it’s policy

decision and enhanced rent from Rs.2.50 to Rs.6.00 in terms of G.O.Ms.No.37 Finance (FMU-TR&B) Department dated 07.03.2016 and moreover, the then District Collector, Kadapa has passed orders effecting such enhanced rents from Rs.4,808/- to Rs.11,538/- per month with effect from 01.02.2018 only vide proceedings dated 22.03.2018. Accordingly, the petitioner was paid arrears and the 4th respondent is continuing to pay the rents as per the above said enhancement to the building premises of the 4th respondent to the petitioner. 6. In view of the above said facts and circumstances, this writ petition is disposed of, directing the respondent Nos.2 to 4 to continue to pay the rents for the subject building, which is in occupation of the 4th respondent as per the agreed rent. The written instructions of the 4th respondent dated 07.11.2025 shall be made as part of the Court record. Interim order if any deemed to have been vacated. There shall be no order as to costs.
