Heard the parties.
The petitioner has been made accused in connection with Giridih (T) P.S. Case No. 111 of 2024, corresponding to S.T. No.422 of 2024 (M.C.A. No.06/25), for the offences registered under Sections 302, 342, 324 & 326/34 of the Indian Penal Code, pending in the court of learned Additional Sessions Judge-IX, Giridih.
On 15.05.2024 at about 7:00 a.m., petitioner alongwith co-accused persons intercepted the brother of the informant namely Chotu Yadav near Nikhar Hotel. It is alleged that co-accused Rahul Yadav, Prakash Yadav and Pradeep Yadav stabbed him, due to which, he succumbed to his injuries.
Learned counsel for the informant, assisted by learned A.P.P on behalf of the State have vehemently opposed the prayer for bail and submitted that there is allegation against the petitioner that he had caught hold of the deceased. It was further submitted that the trial has already commenced and six witnesses have been examined.
Learned counsel for the petitioner has submitted that co-accused Rama Das @ Ramu Kumar Das has been granted bail by this Court in B.A. No. 10774/2024. It further appears that there is no allegation against the petitioner that he had stabbed the deceased.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-IX, Giridih, in connection with Giridih (T) P.S. Case No. 111 of 2024, corresponding to S.T. No.422 of 2024 (M.C.A. No.06/25).
