Hegde, learned counsel for the respondent No.1. 2. Defendant Nos.1 to 4 are the revision petitioners, challenging the validity of the order passed by the Civil Judge, Senior Division, Sira, rejecting the application filed by the revision petitioners under Order VII Rule 11 (a) to (e) of CPC. 3. Parties are referred to as plaintiffs and defendants for the sake of convenience as per their original ranking before the trial Court. 4. Facts in the nutshell which are at most necessary for disposal of the present revision petition are as under: 5. First respondent and other respondents being the plaintiffs filed a suit with the following prayer in respect of the following property (hereinafter referred to as the ‘suit property): PRAYER “Wherefore the plaintiffs pray that this Hon'ble Court may be pleased to pass judgment and - 9 - HC-KAR NC: 2025:KHC:43016 CRP No. 585 of 2025 decree in the suit in favour of the plaintiffs and against defendants. a. for partition of 1/4th share jointly allotted to plaintiff Nos.1 to 4 and 1/4th share jointly allotted to plaintiff Nos.5 to 7 and defendant No.6 and separate possession of item Nos. 1 to 5 of schedule properties, holding that the following sale deeds and partition deed are not binding on the plaintiffs shares namely: 1. Sale deed dated 03.05,2020, registered as Document No.SRA-1-00482/2020-21, stored in CD No.SRAD 667 executed by defendant No.2 in favour of defendant No.25 in respect of Site No.16 in ltem No.1 of schedule property.” SCHEDULE Item No.1: All that piece and parcel of landed property bearing Sy.No.217/1, (Old Sy.No.50/3) situated at Kallukote Village, Kasaba Hobli, Sira Taluk, Tumkur District, measuring an extent of 2 acres 37 guntas and 7 guntas of A Kharab land and 3 guntas of B Kharab land, presently converted land comprising of Residential Sites No.1 to 57 bounded on the; East by : Govt. land and thereafter private lands West by: Parasappa and others land North by: Sannapa and others land South by : H.Ramaiah and others land. Item No.2: All that piece and parcel of house property, bearing house No.6, Assessment No.934/895/855, within the limits of City Municipal Council, Sira Town, Sira Taluk, Tumkur District, measuring East to West:44 feet, North to South :30 feet bounded on the; East by: Road, West by: Shakunappa house property North by:Ramesh house property - 15 - HC-KAR NC: 2025:KHC:43016 CRP No. 585 of 2025 South by: Kadurappa house property. Item No.3: All that piece and parcel of land bearing New Sy.No.503/2, (old Sy.No.503) measuring an extent of 3 acres situated at Kotta Village, Kasaba Hobli, Sira Taluk, Tumkur District, bounded on the East by : Land of Dasarahali Bendappa, West by : Government Gomal North by : Land of M.Shankarappa Bin Mahalingappa South by: Land R.S.No.208/1 Item No.4: All that piece and parcel of land bearing Sy.No.208/1, measuring an extent of 27 guntas situated at Kotta Villge, Kasaba Hobli, Sira Taluk, Tumkur District. Item No.5: All that piece and parcel of land bearing Sy.No.208/3, measuring an extent of 3 acres 14 guntas situated at Kotta Village, Kasaba Hobli, Sira Taluk, Tumkur District. Item No.4 and 5 properties are adjacent to each other having common boundary, bounded on; East by : Land of Dasarahalli Bendapa West by :Govt. Gomal Land North by :R.S.No.503/2 land South by: Sharadamma land” - 16 - HC-KAR NC: 2025:KHC:43016 CRP No. 585 of 2025 6. Plaintiffs laid their claim contending that suit property was granted to the great grandfather of the plaintiffs namely, Kariyanna. Plaintiffs claim that the property remained intact and they are the members of the joint family and they are entitled for share in the property. 7. Plaint paragraph 20 deals with the cause of action to the suit which reads as under: “The cause of action for the suit arose during second week of April 2024, and subsequently on 22.04.2024, 24.04.2024 and 26.04.2024 as and when plaintiffs demanded defendant Nos.1 to 6 to effect partition of the HUF properties and subsequently as and when legal notice dated 01.05.2024 is issued and subsequently as and when defendant Nos.1 to 6 refused to effect partition within the territorial jurisdiction of this Hon’ble Court.” 8. Pursuant to the suit summons, defendants entered appearance and filed written statement and additional written statement as the plaint got amended. - 17 - HC-KAR NC: 2025:KHC:43016 CRP No. 585 of 2025 9. Defendant Nos.1 to 4 claim under one Rangashamaiah, whose common prepositous is also Kariyanna. Defendants 1 to 4 also filed an application under Order VII Rule 11 CPC stating that suit is barred by limitation. 10. When plaintiffs and defendants are laying claim on the suit property based on the grant made by the Government in favour of common prepositous Kariyanna, only on the ground of limitation, plaint cannot be rejected at the threshold. 11. Suit in the trial Court is also progressed and there is already amendment of the pleadings. 12. In support of arguments, Defendants 1 to 4 placed on record the following decisions: (i) T. Arivandandam vs. T.V. Satyapal and Another, reported in (1977) 4 Supreme Court Cases 467. (ii) Suresh and others vs. Baburao (Thakkubai and others), Bombay High Court, Date of Decision 16.12.2013. 13. Insofar as the judgment of the Aravindanandam’s case is concerned, successive litigations were filed by the unsuccessful plaintiff which were sought to be nipped at the - 18 - HC-KAR NC: 2025:KHC:43016 CRP No. 585 of 2025 bud. Here the plaintiffs have filed the present suit alone above and no other suit has been filed. 14. So also the judgment of the Bombay High Court in the case of Suresh Kumar and others follows the judgment of the Aravindanandam. 15. Facts of the present case are altogether different from the facts involved in Aravindanandam case and the Judgment of the Bombay High Court in Suresh Kumar case supra. 16. Hence, they are of no avail in advancing the case of the revision petitioner. 17. Further, question of limitation usually is a mixed question of law and facts. Unless one can deduced by mathematical precision. Therefore, it cannot be treated as a preliminary issue so as to reject the plaint at the threshold. 18. Taking note of these aspects of the matter, the rejection of the application by the trial Court which is impugned in the present revision petition needs to be upheld. 19. Accordingly, the following: - 19 - HC-KAR NC: 2025:KHC:43016 CRP No. 585 of 2025 ORDER (i) Civil Revision Petition is dismissed. (ii) However, Defendant Nos.1 to 4/revision petitioners are entitled to urge the ground of limitation in the suit in accordance with law.
