For Petitioner : Mr.C.Harish For Respondents : Mr.A.Selvendran Special Government Pleader ***** O R D E R [Made by S.M.SUBRAMANIAM, J.,] This writ petition has been filed seeking a direction to Respondents 1, 3 and 4 to remove the encroachments in “Canal Poromboke” land, comprised in S.Nos.881/1, 880/1, 876/1, 874/1 and 867/1, situated at Chennasamudram Village, Kalavai Taluk, Ranipet District, by considering petitioner’s online complaint in petition No.10251035 dated 28.09.2024. https://www.mhc.tn.gov.in/judis W.P.No.43222 of 2025 Page Nos.3/6 2. When the writ petition was taken up for hearing, the learned Special Government Pleader filed a status report of the sixth respondent, which would show that Authorities have conducted survey and identified the encroachments. Paragraph 7 to 10 of the status report read as under: “7.It is submitted that the form-III was issued to encroachers on 30.01.2026 to remove the encroachment within 21 days of time period. 8. I submitted that on receipt of Form – II notice, the encroacher have raise the objection relating to the clarification of the land, its occupation and to resurvey above the said survey numbers through the District Collector, Ranipet District on 21.01.2026. 9. It is submitted that this respondent addressed the letter to Tahsildar, Kalavai to resurvey the above the said survey numbers and to reconfirm the details of the encroachments as per objection raised by the encroacher on 13.04.2026. 10. It is submitted that the encroachment on the above said survey numbers will be removed as per protection of tank and eviction of encroachment Act, 2007 with help of Revenue and Police Department.” 3. In view of the above stated position, the respondents are directed to evict the encroachers in the water bodies by following the procedures https://www.mhc.tn.gov.in/judis W.P.No.43222 of 2025 Page Nos.4/6 contemplated under the relevant Statutes and Rules in force within a period of twelve weeks from the date of receipt of a copy of this order.
