The petitioner preferred the instant CRMP for modification of the order dated 12.08.2025 passed in CRA No. 1187 of 2024, whereby this court set aside the judgment of conviction and order of sentence and directed for release of the petitioner from jail on furnishing bail bond of Rs. 25,000/- with two reliable sureties. 2. Learned counsel for the petitioner would submit that the appeal of the JYOTI SHARMA Digitally signed by JYOTI SHARMA Date: 2025.10.28 12:02:49 +0530 2 petitioner has been allowed on 12.08.2025 and he was acquitted from the charges u/s 376 & 302 of IPC. She further submits that the petitioner belong to poor family and is unable to arrange two reliable sureties and hence has not been released from the jail till date, despite his acquittal from the criminal charges. She further prays that he may be allowed to furnish personal bond only instead of two reliable sureties and be released. 3. On due consideration and for the reasons stated by the learned counsel for the petitioner, it would be appropriate to modify para 28 of the judgment dated 12.08.2025 delivered in CRA No. 1187 of 2024. Thus, it is ordered that para 28 of judgment 12.08.2025 is modified and now the same be read as under : 28. Keeping in view the provisions of Section 437-A of Cr.P.C. (now Section 481 of BNSS), appellant- Ghanshyam Pardhi is directed to forthwith furnish a personal bond in terms of Form No. 45 prescribed in the CrPC of sum of Rs. 25.000/- before the Court concerned which shall be effective for a period of six months….. 4. The remaining part of the judgment shall remain unaltered. 5. Copy of this order be placed in the record of CRA No. 1187 of 2024 and further it be read along with the order dated 12.08.2025 passed in the said criminal appeal. 6.
