2. Heard Sri K Joseph, learned counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home.
3.
Learned counsel for the petitioner would submit that the petitioner is a wholesale coconut trader and is operating the subject account for business purposes. The account was frozen based on a communication received from the police alleging that a disputed amount of Rs.15,000/- was credited to the petitioner’s account in connection with a cyber crime complaint. Learned counsel further submit that freezing of the entire account has caused severe hardship to the petitioner.
4. Learned Assistant Government Pleader for Home, on instructions, submitted that a cyber crime complaint was registered on the Cyber Crime Portal alleging cheating and impersonation, pursuant to which the fraudulent
money trail was traced to various bank accounts, including the petitioner’s account, and therefore, as a precautionary measure, a debit freeze was imposed to prevent further transfer of funds. It is submitted that the freeze was imposed only in connection with the cyber crime investigation.
5. Learned counsel for the petitioner would further submit that recording the above submission, appropriate orders may be passed permitting for de- freezing of the account after retaining the disputed amount of Rs.15,000/-.
6. Considering the submissions made, the Writ Petition is disposed of. However, respondents are directing to permit de-freezing of the petitioner’s bank account bearing Account No.10240000728025, after withholding/retaining the disputed amount of Rs.15,000/-, if not already retained, in accordance with law. There shall be no order as to costs.
